PRIVACY NOTE PURSUANT TO ARTICLE 13 OF THE EUROPEAN REGULATION 679/16 (GDPR) REGARDING THE

PROCESSING OF PERSONAL DATA

(Privacy code and European regulation covering the protection of personal data)

 

 

In compliance with the new European Regulation 679/16 (the GDPR) and  its following amendments we hereby provide you with the necessary information regarding the processing of your personal data which you provide.

This is an advisory note prepared pursuant to article 13 of the European Regulation covering the protection of personal data.

2.       Processing will be carried out with both manual means and computerised and remote means, in respect of the laws in force and the principles of correctness, lawfulness, transparency, relevance, completeness without being excessive, accuracy and with an organisational and processing logic that is strictly correlated to the purposes pursued and, in any case, in such a way as to guarantee the security, integrity and confidentiality of the data processed, in compliance with the organisational, physical and logical measures provided for by the provisions in force.

 

3.       For the purposes described in this advisory note, only non-particular personal data will be processed.

 

4.        Specific information; Specific information could be showed on the pages of the Website in relation to particular services or processing of data provided by the User or by the Interested Party and appropriate approvals will be collected in the same premises (if necessary)

 

 

5.       Purposes for processing personal data

a)       Any contact request from interested party , replying to them and following up on the contact request/request for information according to customers and contacts needs

the data processed is: your name, surname, your company’s name, address , city, and telephone /fax number, obligatory or not if required.

This data is necessary in order to  follow up on the contact request. Any failure to provide this data, or to provide partial data or incorrect data, will make it impossible  make and / or receive a response to further info request  their requests.

The legal basis for, and the lawfulness of, the processing is in the pre-contractual or contractual obligations connected to providing a service or to replying to a request made by the interested party (article 6(b)).

Data provided for the purposes indicated above will be stored for a period of 6 months.

b)       Communication activities with an advertising and/or promotional nature by email (“Newsletter Service”), subject to specific consent being given: solely for the purpose of sending advertising material and/or material to promote the Controller’s products, services, offers and initiatives, including trade shows and events, the Controller acquires, subject to specific consent being given pursuant to article 6(a) of the GDPR, certain personal/identifying data (email and name) provided directly by the data subject.

If the data subject does not provide this data, it will be impossible for the Controller to carry out the communication activities with an advertising and/or promotional nature.

The legal basis for this processing is in the specific consent given by the data subject (article 6(a) of the GDPR).

Data provided for the purpose indicated above will be processed for as long as the promotional activity runs and, in any case, until the data subject withdraws his/her consent which may be done by contacting the Controller through one of the following channels: email: info@belardi.it, telephone: (+39) 069120294 in the event in which an automated means is provided for in a footer to an email.

 

It should be noted that data provided may be processed in order to protect the Controller’s legitimate interests and, specifically, as part of a defence in a court of law or to collect debt. Even in this event, the principles of not being excessive, proportionality and minimising processing will be applied (article 6(1)(f) of the EU Regulation).

 

 

6.       Distribution of data, recipients and categories of recipient

               

No data will be disseminated in any way whatsoever.

 

Data provided will be processed exclusively by personnel authorised to carry out the processing who have been appropriately trained and who are under the Controller’s control. Processing may also be carried out by assigned Processors connected to the Controller through a specific contract (article 28 of EU Regulation 679/16), such as, for example: companies who provide services to manage information systems and telecommunication networks and who provide consulting services to the Controller, as well as consultants and service providers. Wherever possible, data will be processed in an anonymous form and, in any case, the concepts of minimising processing and the relevance of processing will be applied.

 

Data will be processed within the EU for the purposes referred to in points 4(a) and 4(c).

 

For the purposes referred to in point 4(b), data may be transferred to the supplier, The Rocket Science Group LLC “MailChimp” (Atlanta, Georgia - USA). Guarantees suitable for this transfer are tied to the supplier’s adhesion to the Privacy Shield. For further information on this, and to review certification, go to HTTP://WWW.PRIVACYSHIELD.GOV .

 

The updated list, with the identification details of all the Processors, may be requested from the Controller at any time.

 

Data may also be communicated to third parties (public bodies, police forces, judicial authorities, etc.) but only and exclusively in order to fulfil legal obligations or EU regulations or legislation.

 

7.       The data subject’s rights: articles 15, 16, 17, 18, 19, 20, 21 and 77 of the GDPR

 

We hereby inform you that you have the right to know the recipients of any data communicated, to access the personal data that concerns you, to have this data rectified or deleted and you have the right “to be forgotten”, to restrict processing, to make the personal data that concerns you portable and to oppose, at any moment, the processing of this data.

We also inform you that you have the right to withdraw any consent given to the processing of your personal data at any time without prejudice to the lawfulness of any processing carried out and based on the consent given prior to it being withdrawn (article 7(3) of the GDPR).

 

Pursuant to article 77 of the Regulation, you also have the right to lodge a complaint with a supervisory body, notably in the EU Member State in which you regularly reside or work or in the place where the alleged breach occurred. In Italy, the supervisory body is the Autorità Garante per la Protezione dei dati personali (the Italian Data Protection Authority), which may be reached at www.garanteprivacy.it
